General Terms and Conditions
1. Introductory provisions
These General Terms and Conditions (hereinafter referred to
as "GTC") apply to digital content ("Products"),
stand-alone electronic books ("E-books") and audiobooks
("Audiobooks") that can be purchased through smbmarketingmanager.com
("Website") operated by Noemi Apostol, a sole proprietor (registered
office: 38 Árpád fejedelem útja, 1023 Budapest, Hungary; VAT Identification
Number: HU56690233, hereinafter referred to as "Service Provider").
2. Subject matter of the contract
The Supplier sells E-books and Audiobooks available in
digital format via the Website. Purchases are made electronically, providing
the customer with the possibility to download the products electronically.
3. Conclusion of the contract
An order placed via the Website is concluded by electronic
means, which in itself constitutes a commitment on the part of the Buyer.
Payment is made through Payhip and PayPal. By placing an order, the Buyer
accepts the terms and conditions of these GTC.
4. Payment and fulfillment
Purchases of digital products available on the website are
made through the Payhip checkout system, which is embedded on the website.
During the purchase process, Payhip handles the processing of the order and the
delivery of the digital products. Payment transactions are processed
exclusively by PayPal, which ensures the protection of payment data and the
processing of transactions.
Noemi Apostol sole trader does not process and store any
payment data other than billing data, as the purchase is processed entirely
through Payhip and PayPal. Billing data is processed solely for the purpose of
complying with applicable legal requirements (e.g. tax obligations).
The following service providers' own terms of use and
privacy policies apply to purchases and payments:
By finalising the order, the customer accepts both these
Terms and Conditions and Payhip's and PayPal's own policies.
Upon successful completion of the transaction, the Buyer
will receive a download link to the email address provided, through which the
purchased digital content can be downloaded.
5. Right of withdrawal
Since the purchased products are digital content that is not supplied on a tangible medium, the consumer is not entitled to exercise the right of withdrawal after the download has begun, in accordance with Article 16(m) of Directive 2011/83/EU on consumer rights. By making a purchase, the consumer expressly agrees that access to the digital content will be provided immediately and acknowledges that this results in the loss of the right of withdrawal.
6. Intellectual property rights
All content available on the Website (e-books, audiobooks,
text and visual materials) is the exclusive property of Noemi Apostol sole
proprietor. Distribution, copying or resale of the products is prohibited.
7. Data protection
The Service Provider shall treat the personal data provided
during the purchase as confidential and shall not disclose them to third
parties. The Customer will find more information in the Privacy Policy.

9. Final provisions
The Service Provider reserves the right to unilaterally
modify these GTC. The current version of the GTC is available on the Website.
The Hungarian law shall prevail and in case of dispute the Hungarian courts
shall have jurisdiction.
